The vast majority of Home Inspection Agreements have a “Limit of Liability” clause. The clause limits the inspector’s liability to either the cost of the inspection, the cost of the inspection times two (2), $500 or something of that nature. If the inspector misses something such as the furnace, generally a $2,000 to $5,000 expense, you simply receive from the inspector the amount agreed to in the “Limit of Liability” clause. That leaves you with a large out-of-pocket expense. Your alternative is to fight with the inspectors E&O Insurance to collect. Assuming he even carries E&O insurance.
